POLICY AGREEMENT INFORMATION

PHOTOGRAPHY
One experienced wedding photographer with professional equipment and two cameras covering pre- ceremony, ceremony and reception activities. Photographer will offer direction to the couple and participants during scheduled photo events. Photographer shall focus on candid / action shots of people interacting as well as creative documentary photos in-between scheduled photo opportunities. All usable images will be delivered after processing.

VIDEOGRAPHY
One experienced wedding videographer using two HD professional quality cameras. The second camera should be used at the ceremony and is stationary. Broadcast quality professional wireless lav mic and/or professional shotgun microphone and external audio recorders and video lighting included. If filming for a short film, moments that should be captured in documentary form are ceremony, first dances, and toast.

REGULATIONS: ​This is a contractual agreement for photography and/or videography services between CodyFilms and the CLIENT. This form is required to be signed by the CLIENT along with full payment before the day of the contracted event. photographers/videographers DO NOT accept payments on behalf of CodyFilms, therefore all payments must be finalized up to the DAY BEFORE the contracted event with CodyFilms. Forms of payment accepted are: debit card, credit card or cash.

ENTIRE AGREEMENT: ​This agreement contains the entire contractual agreement between CodyFilms and the CLIENT. It supersedes all prior and simultaneous agreements between the parties and is deemed as the final standing between the CLIENT and CodyFilms. Revisions are not allowed to this contract.

RESERVATIONS AND DEPOSITS: ​In order to reserve a contracted date and time for services, a Deposit is required. Advanced scheduling is required by CodyFilms in coordinating photographers/videographers. Therefore, all deposits are final and are non-refundable.

AGENDA OF EVENT: The client will provide a written agenda to insure that CodyFilms will be prepared to capture all of the memories. Notification beforehand and camera/lighting/audio setup is required to ensure that parts of the event are captured by our photographer or videographer. CodyFilms is not responsible for any part of the event missed due to client not notifying us as where and when that specific part is taking place. If the event runs over the stated time the client will be charged per half hour, per photographer and/or videographer present at the prorated total of this event.

COOPERATION:​ The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. CodyFilms recommends that CLIENT designate an "event guide" to point out important individuals for informal or candid photographs/video to the photographer/videographer during the event that they wish to have photographed or video recorded. The photographer/videographer will not be held accountable for not photographing or having video of desired people if there is no one to assist in identifying people or gathering people for photographs or video. CodyFilms is not responsible if key individuals fail to appear or cooperate during photography/video sessions or for missed images or video due to details not revealed to CodyFilms.

ISSUES: ​The client agrees to contact CodyFilms foremost, if the client has any perceived issues in their services.

SHOOTING TIME / ADDITIONS:​ The photography and/or videography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties.CLIENT and CodyFilms agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.

PHOTOGRAPHER/VIDEOGRAPHER: ​Specified named or requested photographer and (or) videographer is based upon scheduled availability. CodyFilms retains the right to terminate all services without a refund if at any time a member of the staff feels uncomfortable or unsafe. Furthermore CodyFilms will not participate in any unlawful activity deemed by county, city, state or federal agency.

HOUSE RULES:​ The photographer/videographer is limited by the guidelines of the ceremony official or venue or reception site management. CLIENT agrees to accept the technical results of their imposition on the photographer/videographer. Negotiation
with the officials for moderation of guidelines is CLIENT's responsibility; However, CodyFilms will offer technical recommendations and assist in explanations to venues and or officials as required.

FILM and COPYRIGHTS: ​Photographs and video produced by CodyFilms are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without CodyFilms's explicitly written permission. Upon final payment by the CLIENT, limited copyright ownership of the resulting images or video will be transferred to the CLIENT under the following conditions:
The digital negatives are the property of CLIENT for personal use and for the purposes of the reproduction and giving of photographs and videos to friends and relatives.
The Client must obtain written permission from and compensate CodyFilms prior to the CLIENT or its friends and relatives publishing or selling the photographs and videos for profit.

MEALS FOR OUR CREW: ​Client will provide meals for our crew members (if meals are served during the coverage time and exceed 4 hours coverage).
​
LIABILITY FOR EQUIPMENT:​ In the event that a participant or guest at the event damages or removes the equipment of CodyFilms, the CLIENT is responsible for restitution or replacement to CodyFilms.
​
EXHIBITION: ​CLIENT grants CodyFilms permission to display images or video resulting from this contract as an example of CodyFilms photography/video work and for entrance into photographic/video competitions and release all claims to profits that may arise from use of images or video.
​
MODEL RELEASE: ​The CLIENT hereby grants to CodyFilms and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs/video of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases CodyFilms and its legal representatives and assigns from all claims and liability relating to said photographs and video.

LIMIT OF LIABILITY:​ If CodyFilms cannot perform this agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to the photographer's or videographer’s illness or injury, CodyFilms will make every effort to secure a replacement photographer/ videographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package minus the deposit. CodyFilms takes the utmost care with respect to exposure, transportation, and processing the photographs and video media. However, in the unlikely event that photographs, digital media, or equipment have been lost, stolen, or destroyed for reasons within or beyond CodyFilms's control, CodyFilms liability is limited to the return of all payments received for the event package minus the deposit. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be determined by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules

CANCELATION POLICY: CodyFilms holds this time and date for the CLIENT's event and cannot book any other Client into this time and date with the same personnel and equipment. Therefore, if for any reason CLIENT cancels their event, CLIENT will be charged 100% of your total photographic and video services. These cancellation fees shall be liquidated damages to CodyFilms in the event of a breach of contract by CLIENT. The CLIENT shall also be responsible for payment for any CodyFilms materials charges incurred up to time of cancellation.

COMPLETION SCHEDULE: ​Videography and Photography editing completion schedule is 6 weeks from the date of the event but not limited to that schedule. Projects could take up to 12 weeks depending on peek seasons and complexity of each project.
